This is a litttle complicated, but let it be said, when the votes are counted in public, the pols know how to vote, unless of course it’s a voice vote, in which case we would have lost this one. There’s a couple of other things. This “law” (they call it a regulation with teeth) was created by the bureacracy (EEOC) with a lot less support of the people. It goes to show everyone, how far our defacto govt has strayed from the tenets of the original intent of the Constitution of the United States.
In a nut shell, the EEOC passed an enforceable regulation (currently being applied vs the Salvation Army) and the 54 Senators today who voted had their vote to repeal same, thwarted. Is there any body who still thinks our defacto govt shouldn’t be replaced by one that’s more democratic (with a small “d”) and less corporate.

TheEEOC invented this policy in 1980, apolicy which even the 9th Circuit Court ofAppeals has rejected, and which other courtshave called simply “wrong.”In 2007, thanks to Senator Alexander, theSenate added a ban on the EEOC’s anti-Englishlawsuits as part of the agency’s budget. TheHouse agreed on November 8, 2007, by a voteof 218 to 186.Speaker Pelosi promised the CongressionalHispanic Caucus that she would allow noHouse-Senate conference committee meetingsuntil the Senate dropped the Alexanderamendment. She kept her word and the Alexanderamendment died, despite having the support ofa majority in both the House and Senate.Today, Senator Alexander not only returned tofight against the EEOC, he led the fightwell. Alexander insisted upon his amendmentreceiving a roll-call vote, despite requestsfrom both Senators Kent Conrad (D, ND) andTed Kennedy (D, MA) to accept a voice vote.Alexander knew individual accountability wasessential to victory and refused to back down(but did so with a smile).Some stunning switchers on EnglishThe Senate’s 54 to 44 majority vote in favorof the Alexander amendment was a decreaseover its 64 to 33 vote in favor of the Inhofeofficial English amendment to the immigrationbill on June 6, 2007.Remarkably, the Alexander amendment gainedthe votes of two Senators who had opposed theInhofe bill last year: Bayh (D, IN) andDomenici (R, NM), as well as the vote of thenew Republican Senator from Wyoming,Dr. John Barasso.Alas, eleven Senators who voted FOR the Inhofeofficial English amendment in 2007 votedagainst the Alexander English amendment in2008. Four of the first term self-proclaimedmoderate Senate Democrats switched:Cardin (MD), Klobuchar (MN), McCaskill (MO)and Webb (VA). They were joined by DemocratsCarper (DE), Conrad (ND), Dorgan (ND),Mikulski (MD), Nelson (FL), Wyden (OR) andthe former General Chairman of the RepublicanNational Committee, Mel Martinez (R, FL).Curiously, the entire delegation of bothMaryland and North Dakota switched from beingFOR Inhofe to being AGAINST Alexander.How did McCain, Hillary and Obama vote?McCain did not vote on the Alexander amendmenttoday, even though he voted FOR the Inhofeofficial English amendment twice in 2007, aftervoting both FOR and AGAINST the Inhofeamendment in 2006.The vote on the Alexander amendment was the58th Senate floor vote this year and took placeat 3:54 PM.A review of today’s Senate votes (as postedon the Secretary of the Senate’s web page)shows that McCain participated in a2:33 PM vote on the Indian Health Service(Senate vote 54) and then was listed as”not voting” for votes 55 to 72, and thenresumed voting at 9:38 PM (Senate vote 73).English First has always scored non-votesas negative votes and will do so regardingMcCain’s non-vote on English today.Both Hillary and Obama voted against theAlexander amendment today and voted againstthe Inhofe amendment in both 2006 and 2007.What was not accomplished today:As you can tell from the number of the bill(S.Con.Res. 70), the budget resolution isitself nonbinding. Thus, the Alexanderamendment is now attached to a bill thatdoes not have the force of law.Dana Chasin walked readers of Talking PointsMemo through the budget process on March 4:”The Budget Resolution is a quasi-legislativeproduct called a joint resolution. It serves asa blueprint for Congress for the upcoming fiscalyear and the four fiscal years that follow. …”There is no actual requirement that Congressactually adopt such a resolution. It merelysets out general spending and tax goals andinstructions for the authorizing committees,which would need to pass any compliance orenacting legislation separately.”Still, winning is better than losing.
